This Privacy Policy (hereinafter - the "Policy") defines the procedure for the collection, processing, storage, use and protection of personal data of users of the website berry-farm.com (hereinafter - the "Site", "Online Store") by the Farm "Berry-Farm Ukraine" (hereinafter - the "Company", "Seller"). The policy is developed in accordance with the Law of Ukraine "On Protection of Personal Data" dated 01.06.2010 No. 2297-VI, the Law of Ukraine "On Electronic Commerce", the Law of Ukraine "On Protection of Consumer Rights" and other acts of current legislation of Ukraine.

By using the Site, placing an Order or leaving your contact data in the Site forms, the user (the subject of personal data) confirms that he has read this Policy and gives the Company consent to the processing of his personal data under the conditions defined below.

1. Definition of terms

1.1. Personal data - information or a set of information about a natural person who is identified or can be specifically identified (surname, first name, phone number, address, e-mail, etc.).

1.2. Processing of personal data is any action or set of actions performed with personal data, including collection, registration, accumulation, storage, use, distribution, depersonalization, destruction of personal data.

1.4. The owner of personal data is "Berry-Farm Ukraine", which determines the purpose of processing personal data, establishes the composition of this data and the procedures for its processing.

2. List of processed personal data

The Company may process the following personal data of Users:

— surname, first name, patronymic;

— phone number;

— e-mail address;

— address of delivery of the Goods;

— data for legal entities and FPOs, necessary for processing settlement documents (name, EDRPOU/RNOCPP code, payment details);

— technical data: IP address, cookie data, device and browser type, geo-data at the level of the settlement, data about behavior on the Site (viewed pages, items in the cart, etc.).

3. Purpose of personal data processing

3.1. Personal data is processed for the purpose of: registration and execution of Orders, delivery of Goods; accounting and tax accounting; providing communication with the User regarding the status of the Order and consideration of complaints; provision of agronomist consultations and informational support; conducting marketing and advertising activities (with the separate consent of the User); analytics of attendance and improvement of the Site.

4. Legal basis of processing

4.1. Processing of personal data is carried out on the basis of: the User's consent, given by filling out forms on the Site or placing an Order; the need to fulfill the contract (public contract of sale), to which the User is a party; the need to fulfill the requirements of legislation (accounting, tax accounting).

5. Sources of obtaining personal data

5.1. Personal data is obtained directly from the User when filling out order forms, registering a personal account, contacting by phone or in messengers, as well as automatically - with the help of cookies and similar technologies when browsing the Site.

6. Transfer of personal data to third parties

6.1. The Company may transfer the User's personal data to such third parties only to the extent necessary to fulfill the Order: to postal operators and transport companies (in particular JSC "Ukrposhta", LLC "Nova poshta" and other Carriers) — for delivery; payment systems and banking institutions — to carry out calculations; to providers of IT services and hosting — to ensure the technical operation of the Site.

6.2. The site uses Google Ads and Google Analytics (Google LLC) services to analyze traffic and the effectiveness of advertising campaigns. Data about the User's behavior on the Site can be compared with the User's Google account in order to increase the relevance of advertising. The user can view or delete such data at myactivity.google.com. Data processing by Google services is carried out in accordance with Google's privacy policy.

6.3. The Company does not sell or transfer the Users' personal data to third parties for purposes unrelated to the fulfillment of this Agreement or the requirements of the law, without the User's separate consent.

7. Cookies

7.1. The Site uses cookies to ensure the correct operation of the Site, save the User's settings, analytics and advertising purposes (Google Ads, Google Analytics). The user can independently manage cookie settings in his browser, including disabling them, but this may affect the functionality of the Site.

8. Period of storage of personal data

8.1. Personal data are stored for the period necessary to achieve the purpose of their processing, as well as for the periods established by the legislation of Ukraine for the storage of 

primary accounting and tax documents. After the expiration of the specified periods, personal data are destroyed or depersonalized.

9. Rights of the personal data subject

In accordance with Article 8 of the Law of Ukraine "On Personal Data Protection", the User has the right: to know about the sources of collection, the location of his personal data, the purpose of their processing; to receive information about the conditions for providing access to personal data; to access his personal data; to receive a response as to whether his personal data is being processed; to submit a reasoned request to change or destroy his personal data in case of their inaccuracy or unlawful processing; to withdraw consent to the processing of personal data; to protect his personal data from unlawful processing; to file complaints regarding the processing of personal data with the Commissioner for Human Rights of the Verkhovna Rada of Ukraine or to the court.

9.2. To exercise the specified rights, the User may contact the Company using the contact details specified in section 12 of this Policy.

10. Personal data protection measures

10.1. The Company takes organizational and technical measures to protect the Users' personal data from unauthorized access, loss, destruction or dissemination, in particular, limiting access to data to a circle of authorized employees, using protected data transmission channels for online payments.

11. Personal data of minors

11.1. The Site is not intended for independent use by persons under the age of 18. The Company does not knowingly collect personal data of minors without the consent of their legal representatives.

12. Changes to the Privacy Policy
